BIRTHDAY BONUS SALE JULY 2024 – TERMS AND CONDITIONS

• Application
  • These terms and conditions (“Terms”) apply to the July 2024 Ideal Buildings Birthday Bonus Sale Promotion (the “Promotion”).
  • The promoter and organiser of the Promotion is Spanbild New Zealand Limited (trading as Ideal Buildings), a company incorporated in New Zealand (company no. 320297) (“Ideal Buildings”).
• Eligibility

To be eligible for entrance in the Promotion (“Eligible Customer”), you must:

• between 12.00 am NZT on 1 July 2024 and 11.59 pm NZT on 31 July 2024 (‘Promotion Period’) enter an agreement with a participating Ideal Buildings distributor for the purchase of an Ideal Buildings carport, garage, sleepout (including garage sleepouts) or cottage, which will be constructed by the relevant Ideal Buildings distributor (i.e., excluding kitset-only purchases) (“Qualifying Product”).;
• agree to pay the full list price under the relevant agreement for the Qualifying Product provided by the relevant Ideal Buildings distributor, without discount;
• pay the deposit for the Qualifying Product in full during the Promotion Period;
• be aged 18 years or older; and
• not be an employee, contractor, or otherwise engaged by Ideal Buildings or any Ideal Buildings distributor (or be an immediately family member of any such person).

• Gifts
  • The Gift will be a “Prezzy Card” Visa gift card (“Gift”). The value of the Gift which the Customer is eligible for will be based on the contract price for the Qualifying Product purchased, as follows:
    • Carports: $500;
    • Garages: $1,500;
    • Sleepouts (including Garage Sleepouts): $2,000;
    • Cottages: $3,000
  • The Gift:
    • is not transferrable;
    • cannot be redeemed for cash;
    • is subject to availability and only while Ideal Buildings’ inventory of the Gifts last; and
    • cannot be exchanged for another item.
  • Notification and delivery
    • The relevant Ideal Buildings distributor will arrange for the appropriate Gift to be supplied to each Eligible Customer once the customer becomes an Eligible Customer, has paid for the Qualifying Product in full, and practical completion of the construction of the Qualifying Product has been achieved. Delivery of the Gift to the Eligible Customer shall be arranged by the relevant Ideal Buildings distributor. No representations are given as to timeframes for delivery of the Gift, and the Eligible Customer acknowledges that any estimated delivery date provided may be delayed due to supply chain or freight issues.
    • Neither Ideal Buildings nor the relevant Ideal Buildings distributor will be liable for:
      • any failure to deliver the Gift (provided that the relevant Ideal Buildings distributor attempts to delivers the Gift to the Eligible Customer’s address as noted in the agreement between the Ideal Buildings distributor);
      • any failure or inability on the part of the Eligible Customer to claim or receive the Gift or
      • any loss or misplacement of the Gift by the Customer.
    • Refunds
      • In the event that the Eligible Customer cancels the agreement for the purchase of the Qualifying Product following redemption of the Gift, Eligible Customer shall promptly reimburse Ideal Buildings for the value of the Gift, and Ideal Buildings shall be entitled to recover the value of the Gift from the Eligible Customer as a debt due.
    • Decisions
      • The decisions of Ideal Buildings regarding all aspects of the Promotion, including decisions regarding the eligibility of customers, the conduct of the Promotion, the interpretation of these Terms, and the allocation of the Gift are final and not subject to challenge.
      • To the maximum extent permitted by law:
        • no decision of Ideal Buildings in connection with the Promotion, may be challenged on any grounds, including due to any alleged or actual failure of Ideal Buildings to act reasonably, in good faith, or fairly;
        • the decisions of Ideal Buildings will remain binding and final even if those decisions are challenged on any ground, including in connection with any factual error or any allegation that such decisions are based on unreasonable, irrational, or irrelevant considerations.
      • Cancellation, changes, or substitution
        • To the extent permitted by law, Ideal Buildings may, at any time:
          • substitute the Gift with a Gift of equal or greater value;
          • cancel the award of any or all Gifts;
          • supplement or change any conditions of eligibility contemplated by clause 2;
          • consider or not consider late entries to the Promotion; and
          • waive any irregularity or informality of any entry to the Promotion.
        • Additional terms

Redemption of a Gift is subject to any terms and conditions of Prezzy Card applicable to the issue and redemption of the Gift, and any other terms and conditions in connection with your use of the Gift.

• Breach of terms

Ideal Buildings may disqualify your entry into the Promotion, or withhold delivery of the Gift from you, if Ideal Buildings believes that you have breached any of these Terms. 

• Privacy

Personal information that you provide to Ideal Buildings (and/or any Ideal Buildings distributor) in connection with the Promotion and the Gift may be used, held, and disclosed by Ideal Buildings:

• for the purpose of conducting the Promotion;
• to facilitate Ideal Buildings’ market research, including to develop new products, services, strategies, and policies; and
• otherwise in accordance with Ideal Buildings’ privacy policy, available from time to time at https://www.idealbuildings.co.nz/privacy-policy/.

• Governing law and jurisdiction
  • The Promotion and these Terms will be governed by New Zealand law and the courts of New Zealand will have the exclusive jurisdiction to hear and determine all claims arising in connection with the Promotion or these Terms.
• Ideal Buildings Christchurch & North Canterbury
  • Purchases from Ideal Buildings’ Christchurch & North Canterbury Branch (operated by Spanbild New Zealand Limited trading as Ideal Buildings’ Christchurch & North Canterbury) shall be excluded from the Promotion.
